Article 1. Applicability
1.1 These General Terms and Conditions of Sale (hereinafter: terms and conditions) apply exclusively to all offers, orders, and agreements of C.A.T.S. UNLIMITED (hereinafter: C.A.T.S. UNLIMITED), to the exclusion of any other general terms and conditions.
1.2 Deviations from these terms and conditions can only be made in writing, in which case the remaining provisions remain fully in force.
1.3 Placing an order implies that you unconditionally accept the applicability of these terms and conditions.
Article 2. Agreement and Website Offers
2.1 All offers from C.A.T.S. UNLIMITED are without obligation, and C.A.T.S. UNLIMITED expressly reserves the right to change prices.
2.2 An agreement is only concluded after C.A.T.S. UNLIMITED has accepted your order. C.A.T.S. UNLIMITED is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise.
2.3 Some of the offered products have an age classification. By ordering these products, you declare that you meet the required minimum age.
Article 3. Delivery
3.1 The delivery times provided by C.A.T.S. UNLIMITED are indicative only. Exceeding any delivery term does not entitle you to compensation, nor does it grant you the right to cancel your order or dissolve the agreement unless the delay is such that it is unreasonable to expect you to maintain the agreement. In that case, you are entitled to cancel the order or dissolve the agreement to the extent necessary.
3.2 The delivery of the products takes place at the location and time when the products are ready for shipment to you.
3.3 It is necessary to provide a correct address for delivery. If an incorrect address is provided and the order is not delivered as a result, the additional shipping costs will be borne by the buyer.
3.4 If you choose delivery outside the Netherlands, please provide your email address and phone number, so the shipping company can contact you if necessary.
Article 4. Pricing and Payments
4.1 The stated prices for the offered products and services are in euros, including VAT and excluding handling and shipping costs, as well as any taxes or other charges unless otherwise stated or agreed upon in writing.
4.2 Payment via the webshop must be made immediately upon purchasing the product.
4.3 Payment can be made by credit card, PayPal, Klarna, iDEAL, BanContact, or bank transfer. Webshop orders must be paid immediately, except when using the CLAIM code.
4.3.1 If you use this code in the ordering process, comics will be reserved, and acceptance of the offer, as well as payment, will be postponed until the end of the month. This allows you to accumulate multiple products from the website or our Live Sales. This is called stacking.
4.3.2 Customers can reduce shipping costs by reserving and accumulating their orders through our saving and reservation system. The customer thereby expresses an intent to purchase. The actual offer and acceptance occur later, namely at invoicing (offer) and payment (acceptance).
4.3.3 These stacked products will be confirmed with you at the end of the month and settled via the website after acceptance of the offer. We apply a payment term of 14 days.
4.4 If you fail to make any payment, C.A.T.S. UNLIMITED is entitled, without notice of default, to suspend or dissolve the execution of the relevant agreement and related agreements, without prejudice to its rights.
Article 5. Retention of Ownership
5.1 The ownership of delivered products remains with C.A.T.S. UNLIMITED until you have fulfilled all obligations arising from any agreement with C.A.T.S. UNLIMITED. The risk concerning the products transfers to you at the moment of shipment.
Article 6. Intellectual and Industrial Property Rights
6.1 You must fully and unconditionally respect all intellectual and other proprietary rights associated with the products supplied by C.A.T.S. UNLIMITED.
6.2 C.A.T.S. UNLIMITED does not guarantee that the delivered products do not infringe on any (unwritten) intellectual and/or industrial property rights of third parties.
Article 7. Complaints and Liability
7.1 You are required to check upon delivery whether the products comply with the agreement. If this is not the case, you must inform C.A.T.S. UNLIMITED as soon as possible, and in any case within seven working days after delivery, in writing and with a reasoned explanation.
7.2 If you wish to return a product for any reason, you have a 14-day reconsideration period starting from the date of receipt. After this period, the product must be returned to C.A.T.S. UNLIMITED within fourteen working days. Returns are only accepted if the original packaging, including the foil, remains intact.
Article 8. Printing and Typographical Errors Reserved
8.1 All prices are subject to printing and typographical errors. We accept no liability for the consequences of printing and typographical errors.
8.2 All prices on the website are in euros, including VAT and excluding shipping costs. Appropriate shipping costs are charged during order processing.
Article 9. Orders/Communication
9.1 C.A.T.S. UNLIMITED is not liable for damages, delays, or errors in orders and communications due to the use of the Internet or any other communication method between you and C.A.T.S. UNLIMITED or between C.A.T.S. UNLIMITED and third parties, except in cases of intent or gross negligence by C.A.T.S. UNLIMITED.
Article 10. Force Majeure
10.1 Without prejudice to its other rights, C.A.T.S. UNLIMITED has the right, in the event of force majeure, to suspend the execution of your order or dissolve the agreement without judicial intervention, without being liable for any compensation unless this would be unreasonable under the given circumstances.
Article 11. Miscellaneous
11.1 Many products feature a catalog image, meaning they are supplier-provided images. Minor deviations may occur.
11.2 If you provide C.A.T.S. UNLIMITED with a written address, C.A.T.S. UNLIMITED is entitled to send all orders to that address unless you provide a different shipping address.
Article 12. Governing Law and Competent Court
12.1 All rights, obligations, offers, orders, and agreements to which these terms apply are exclusively governed by Dutch law.
12.2 All disputes will be submitted to the competent court in the Netherlands.
